Considering the evolving COVID-19 situation, protecting the health and welfare of the community is of utmost concern.  As such, the meeting will be held remotely, with Board members, Staff and Applicants participating via online meeting venue.  The public can listen to the meeting via audio live stream at: (link forthcoming).   Interested persons can submit written testimony in advance of the meeting, which will be distributed to Board members prior to the meeting.  We request that testimony be submitted not later than 24 hours prior to the meeting to ensure time for Board members to review it.  Submit written testimony to: [email protected].

In some of the matters before the Board, a person may wish to request a contested case hearing.  If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it.  A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision.  It is up to you.  Any request must be made in writing within ten days.  If no request for contested case is made, the Board will make a decision.  The Department will treat the decision as final and proceed accordingly.

D. LAND DIVISION

1. Cancellation of Governor’s Executive Order No. 3633; Partial Withdrawal of 103.041 Acres from Governor’s Executive Order No. 4259;  Reset Aside of the 164.353 Acres Formerly Under Governor’s Executive Order No. 3633 and the 103.041 Acres Withdrawn From Governor’s Executive Order No. 4259 to the Agribusiness Development Corporation for Agricultural and Related Purposes, Kekaha, Waimea, Kauai,  Tax Map Keys: (4) 1-2-002:001, 006, 022, 035, 042 & 043, and (4) 1-2-016:001 through 020.

The purpose of the amendment is to expand the character of use to include temporary storage and school events in addition to parking. 

3. Amend Prior Board Action of September 9, 2010, Item D-2, Sale of Lease at Public Auction and Issuance of a Revocable Permit for Pasture Purposes, Portion of Kapaa Homesteads, First Series, Kapaa, Kawaihau, Kauai, Hawaii; Tax Map Keys: (4) 4-6-03:22, 23.

The purpose of the amendment is to obtain Board approval for the annual renewal of the revocable permit after-the-fact from January 1, 2011 through December 31, 2020, together with appropriate rent therefor.
