Honolulu Fisherman Fined $250 for Throw Net Violation

HONOLULU –A state Department of Land and Natural Resources (DLNR) Division of Conservation and Resources Enforcement (DOCARE) officer cited a fisherman for using a throw net with mesh of less than two inches in waters off Aina Haina on Feb. 5. The officer spotted the man fishing with a throw net from shore while on routine patrol.

On March 5, Virgilio Malinay of Honolulu, was charged and sentenced at Honolulu District Court for violating Hawaii Administrative Rule (H.A.R.) 13-75-10(a), which prohibits anyone in the water or on the shore where fish can be taken from possessing a throw net with mesh that is less than two inches stretched. Malinay pleaded no contest and was fined $250. This violation is a petty misdemeanor.

“We are pleased with the court decision rendered in this case,”said DOCARE Chief Randy Awo. “This decision recognizes the value of ensuring that members of the public engage in responsible and lawful fishing practices that contribute toward a healthy and sustainable fishery within Hawaii.”
