Chapter 13-60.4, “West Hawaiʻi Regional Fishery Management Area, Hawaiʻi”

Public hearing on the proposed amendment of HAR Chapter 13-60.4, “West Hawaiʻi Regional Fishery Management Area, Hawaiʻi.” The proposed amendments include 1) extending the moratorium on the taking of Pākuʻikuʻi through 2026; 2) establishing a Pākuʻikuʻi Fisher Registration requirement with registration Terms and Conditions for any take of Pākuʻikuʻi, including mandatory Pākuʻikuʻi catch reporting, through 2036 while establishing a bag limit of zero (0) Pāku‘iku‘i per person per day through 2036 (the proposed bag limit of zero (0) is a placeholder to facilitate further discussion on bag limits); and 3) making other non-substantive amendments for clarity and consistency with other chapters

Chapter 13-60.4 “West Hawaiʻi Regional Fishery Management Area, Hawaiʻi”

Amendments to Hawaii Administrative Rules, Title 13, Chapter 60.4, “West Hawai‘i Regional Fishery Management Area, Hawai‘i,” to: Extend the Moratorium on the Taking of Pāku‘iku‘i Through December 18, 2026 and Make Other Non-Substantive Amendments for Clarity and Consistency with Other Chapters.

These draft rule amendments were heard by the Board of Land and Natural Resources at their regularly scheduled meeting on Friday, September 27, 2024 (See Agenda Item F-1) and these rule amendments were approved to go to public hearing. A statewide public hearing was held on November 13, 2024, on Zoom and in-person in Kailua-Kona, Hawaii Island. A video recording of the public hearing is available here.

Chapter 13-48.5,
“Maunalua Bay Fisheries Management Area, Oʻahu”

This rulemaking action is a request to adopt a new chapter under the Hawaii Administrative Rules (HAR) as Title 13, Chapter 48.5, “Maunalua Bay Fisheries Management Area, Oʻahu” to create long-term sustainable fishing within Maunalua Bay; protect ecologically critical and socially important marine life while minimizing impacts to sustainable fishing; conduct data collection and monitoring to inform fisheries management; and develop an inclusive stakeholder-endorsed science-based decision making process. These rules will prohibit the take of five invertebrate species (‘alakuma, horned helmet, Triton’s trumpet, ula, and ula pāpapa) and prohibit fishing with a spear at night.

The BLNR has approved the draft rules for public hearing and a statewide virtual public hearing has been scheduled for Wednesday, October 2, 2024. See public hearing information above.
