How are E-foils Regulated in Hawaii?

An electric hydrofoil surfboard, also known as an “e-foil,” is:

1) a motorized vessel that must be registered;

2) not a thrill craft;

3) subject to carriage requirements for a Class A vessel like a SUP if past a surf break;

4) required to comply with all laws and regulations that apply to motorized vessels, including speed regulations, operation in proximity to marine animals, and prohibited areas.

Please note that all motorized vessels are required to proceed at a speed of slow-no-wake (approximately five (5) MPH) when within 200 feet of any shoreline, float, dock, launch ramp, congested beach, swimmer, diver’s flag, or anchored, moored or drifting vessel and to a reasonable rate elsewhere (HAR 13-244-9).  This speed restriction applies even if the vessel does not generate a wake.

Boating safety education is required if the power rating of a motorized vessel is 10HP (7.457KW) or more.  Even if your e-foil’s power rating is under this threshold, DOBOR highly recommends completing a course to get an understanding of boating laws, rules, and practices.  Information about DLNR-approved boating safety courses is available at DOBOR’s Mandatory Education Page.
