Late written testimony will be retained as part of the record and distributed to Board members as soon as practicable, but we cannot ensure the Board will receive it in sufficient time to review, prior to decision-making.

The Board may go into Executive Session pursuant to section 92-5(a)(4), HRS, in order to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

C. DIVISION OF FORESTRY AND WILDLIFE

1. Acceptance of Hearing Master’s Report, request for approval to amend and compile Title 13, Chapter 209, Hawaii Administrative Rules: Rules Regulating Activities within Natural Area Reserves (NARS)

The rule amendment can be reviewed online at: http://ltgov.hawaii.gov/the-office/administrative-rules/ or can be reviewed in person at any Division of Forestry and Wildlife district office from 8:00 am to 3:30 pm, Monday through Friday, except State holidays.

2. Set aside of approximately 342 acres as an extension of the Puu Makaala Natural Area Reserve, Tax Map Key 2-4-08:09 por, South Hilo, Hawaii.

3. Request for delegation of authority to the Chairperson to negotiate, approve, execute, amend, extend, and terminate Memorandums of Understanding between the department and other government agencies or private entities to conduct management activities such as invasive species and fire control, restoration/introduction of native species, infrastructure installation and maintenance, and monitoring of resource conditions. 4. Authorize the Division of Forestry and Wildlife to conduct a public hearing to set aside parcels as an extension of the ʻAhihi Kīnaʻu natural area reserve, Tax Map Keys (2) 2-1:006:076 and (2) 2-1:004:111, Maui. [Testimony – 10/24]
