In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

D. LAND DIVISION

1. Amendment of Lease Agreement, LOPP-HA-230, of Private Property with Kahua Ranch Limited on Behalf of the Department of Accounting and General Services, Office of Enterprise Technology Services (formerly known as Information and Communications Services Division) for Radio Facilities Purposes, Waiaka and Kahualiilii, North Kohala, Hawaii, Tax Map Key: (3) 5-9-002:002 (Portion).

The purpose of the amendment is to extend the one automatic extension of a lease agreement between the Board of Land and Natural Resources on behalf of the Department of Accounting and General Services, Office of Enterprise Technology Services, as lessee, and Kahua Ranch Limited, lessor, from five (5) years to 20 years, to increase the rent payable under the lease from $1 per year to $40,000 per year effective November 26, 2023, with a 5% increase every 5ᵗʰ anniversary thereafter through the extended term, and to remove a requirement under Article II, Section 2.6 of the original lease agreement to allow Hawaii Electric Light Company access to the facility.

2. Annual Renewal of Revocable Permits for Maui. See Exhibit 2 for list of Revocable Permits.

3. Issuance of Right-of-Entry Permit to the Department of Transportation, Highways Division, for Access and Construction Purposes, Various, Koolau, Maui, Tax Map Keys: (2) 2-9-014:001 Por., (2) 1-1-001:052 Por., (2) 1-2-001:003 Por., and (2) 1-2-004:005 Por. and; Set Aside to the Department of Transportation for Highway Purposes at Nahiku, Koolau, Maui, Tax Map Key: (2) 1-2-001:003 Por. [Withdrawn – 10/09/25]

4. Issuance of Right-of-Entry Permit to the Department of Land and Natural Resources, Division of Forestry and Wildlife (DOFAW) for Management Purposes, Including Authorization for DOFAW to Issue Permits Pursuant to Chapters 13-104, 13-122, 13-123, 13-124, 13-126, and 13-209, Hawaii Administrative Rules (HAR); Government Lands on Kauai, Oahu, Molokai, and Maui. See Exhibit A for list of Tax Map Keys.

5. Amend Prior Board Action of May 27, 2016, (Item D-11), Consent to Assign, and Amend Grant of Non-Exclusive Easement No. S-5910, Richard E. Reese, Trustee of the unrecorded Richard E. Reese Living Trust dated July 14, 1993, as Assignor, to Thomas R. Hammond and Kathy S. Ohara, as Assignee; as amended by Board action of March 10, 2017, (Item D-5), Amend change in ownership of the adjacent private property to Janine S. Clifford, Trustee of the Janine S. Clifford Trust dated January 26, 2007, restated October 22, 2010, and amended September 25, 2012 and June 2, 2015, as Assignee; Makiki, Honolulu, Oahu, Tax Map Key: (1) 2-5- 020: portion of 002.

This amendment is to seek authorization to remove the signature block for the assignors in the standard consent to assignment document regarding the assignments of Grant of Non-Exclusive Easement No. S-5910; and update the insurance provision to the current standards.

6. Report on Hawai‘i Supreme Court Published Opinion in Sierra Club v. Bd. of Land & Nat. Res., No. SCWC-22-0000516 (Haw. Sept. 5, 2025). [Testimony – 10/6]

F. DIVISION OF AQUATIC RESOURCES

1. Request for Authorization and Approval to Issue a Papahānaumokuākea Conservation and Management Permit to the Monument Management Board Agencies: the U.S. Fish and Wildlife Service Ecological Services and Refuges; National Oceanic and Atmospheric Administration Office of National Marine Sanctuaries and National Marine Fisheries Service (inclusive of the Hawaiian Monk Seal Research Program’s Activities); and the Office of Hawaiian Affairs, for Access to State Waters to Conduct Conservation and Management Activities and Authorize General Conservation and Management Activities by the Department of Land and Natural Resources, Divisions of Aquatic Resources & Forestry and Wildlife.

K. OFFICE OF CONSERVATION AND COASTAL LANDS

1. Request for Administrative Fines and Other Penalties Against Kuaehu Condominium, including Unit Owners Leland V Wigington Jr and David W West, for Conservation District Enforcement Case KA 21-12 regarding Alleged Permit Noncompliance, Construction of Shoreline Erosion Control Device, and Encroachment Upon State Land Located Makai of 4880 and 4888 Aliomanu Road, Tax Map Key (TMK): (4) 4-9-004:004.
