In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

C. DIVISION OF FORESTRY AND WILDLIFE

1. Deny Request for a Contested Case Hearing filed by Petitioner E Pa‘a Ka‘u for  the Action Approved by the Board of Land and Natural Resources (Board) at its Meeting held April 25, 2025, under Agenda Item C-1:

(1) Approve five grants of available funds from the fiscal year 2025 land conservation fund for the acquisition of interests and rights in specific parcels of land having value as a resource to the state (total area approximately 2,711 acres) …

B. The Nature Conservancy, up to $2,000,000 (full funding) for the acquisition of approximately 1,916.058 acres at District of Ka‘ū, Island of Hawai‘i (Hīlea), Tax Map Key Number (3) 9-5-018:001, with a grant of exemption for any easement required pursuant to Section 173A-4, Hawaii Revised Statutes.

According to Section 92-5(a)(4), Hawaii Revised Statutes, the Board may go into Executive Session to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

2. Request for authorization to temporarily close a portion of the Hau‘ula Forest Reserve, including hunting Unit C and A Section of the Ma‘akua Ridge-Papali Trail, to contain and eradicate little fire ants (Wasmannia Auropunctata).

Authorize Chairperson to Sign the Unilateral Agreement and Declaration of Conditions for State Land Use District Boundary Amendment relating to General Lease No. S-5548, Hana Health, a Hawai`i nonprofit corporation, formerly known as Hana Community Health Center, Inc., Lessee, Kawaipapa, Hana, Maui, Tax Map Keys: (2) 1-4-003:022 and 024.

3. Denial of Petition for Contested Case Hearing filed by the Native Hawaiian Legal Corporation on behalf of Na Moku Aupuni O Ko’olau Hui on December 19, 2024, Regarding Agenda Item D-9, Approved as Amended on December 13, 2024: Issuance of Revocable Permit to Alexander & Baldwin, Inc. and East Maui Irrigation Company, LLC for the Development, Diversion, and Use of Surface Water for Diversified Agriculture, Currently Existing Historical Industrial and Non-Agricultural Uses, Reservoir, Fire Protection, Hydroelectric, and County of Maui Department of Water Supply and Kula Agricultural Park Purposes on the Island of Maui; Tax Map Keys: (2) 1-1-001:044 and 050, 1-1-002:002 (por.), 1-2-004:005 & 007, 2-9-014:001, 005, 011, 012 & 017. Pursuant to Section 92-5(a) (4), Hawaii Revised Statutes (HRS), the Board may go Into Executive Session in order to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities and liabilities.

4. Issuance of Right-of-Entry Permit for One (1) Day to Point One Vision for the Oahu Pentathlon Swim, Run, Paddle, Bike, Carry, and Bike Race Event to Take Place on August 9, 2025, at Castles Beach, Kailua, Oahu, Tax Map Key: (1) 4-3-083: seaward of 016 and Kokololio Beach, Hauula, Oahu, Tax Map Key (1) 5-5-001: seaward of 002.

5. Amendment of Grant of Non-Exclusive Easement No. S-5164 to Henry Albert Mohrschladt for Seawall and Loose Rock Wall for Landscaping Purposes; Paumalu, Koolauloa, Oahu, Tax Map Key: (1) 5-9-001: portion of 038. The purpose of amending the document is to (1) insert a provision allowing the easement to be appurtenant to and inure to the benefit of the private real property identified as Tax Map Key: (1) 5-9-001:026, CPR No. 0002; (2) updating the insurance provision to meet the current requirements.

6. Amend Prior Board Action of June 14, 2024, Item D-4, Request for Mutual Cancellation of Grant of Non-Exclusive Easement No. 5476 to Andrea Mapuna Peters, also known as Andrea Mapuana Peters, Grantee; Waimanalo, Koolaupoko, Oahu; Tax Map Key: (1) 4- 1-007: adjacent to 065.
The purpose of the amendment is to remove the requirement for the grantee to sign the mutual termination agreement.

7. Amend Prior Board Action of August 28, 2020, Item D- 10; Amend Grant of Non- Exclusive Easement No. S-5669 for Seawall Purposes, Bank of Hawaii as Trustees for the Tsugio Ueyama Revocable Living Trust dated July 10, 2001 and the Jane N Ueyama Revocable Living Trust dated July 10, 2001, and Lynn M. Wong, Grantees, Wailupe, Honolulu, Oahu, TMK (1) 3-6-003: seaward of 015.

The purpose of this amendment is to increase the easement area by 16 square feet.

Rescind Prior Actions of June 9, 2006, Item D-8 and October 12, 2007, Item D-5.

The purpose of this amendment is to allow the easement to be appurtenant to and inures to the benefit of the private property identified as TMK (1) 3-6-003:015.

F. DIVISION OF AQUATIC RESOURCES

1. Request for Authorization and Approval to Amend the Board of Land and Natural Resources’ (BLNR’s) Prior Authorization and Approval for the Issuance of a Papahānaumokuākea Marine National Monument Conservation and Management Permit (PMNM-2025-004) Issued to Mr. James Morioka, Papahānaumokuākea Marine Debris Project (PMDP), for Access to State Waters to Survey and Remove Marine Debris and Disentangle Marine Life as Needed within the Waters of the Northwestern Hawaiian Islands.

K. OFFICE OF CONSERVATION AND COASTAL LANDS

1. Conservation District Use Application (CDUA) HA-3969 for Subdivision of Land by the County of Hawaiʻi Department of Public Works Located at Piʻihonua, South Hilo, Hawaiʻi, Tax Map Key: (3) 2-3-030:002. [Testimony]
