The Board may go into Executive Session pursuant to section 92-5(a)(4), HRS, in order to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

1. Approval of May 8, 2026 Meeting Minutes.

C. DIVISION OF FORESTRY AND WILDLIFE

1. Approval to Enter into a Nondisturbance and Attornment Agreement; Agreement Regarding Distribution of Sales Proceeds; and Consent with Hookuaaina and the City and County of Honolulu to Facilitate Hookuaaina’s Acquisition of Approximately 116.49 Acres at Pālāwai, Koolaupoko District, Island of Oahu, Tax Map Key Nos. (1) 4-2-008:001 and (1) 4-2-007:043, Under a Fiscal Year 2023 Legacy Land Conservation Program Grant Award; and Authorization for the Chairperson to Negotiate and Execute the Agreement.

2. Request for delegation of Authority to the Administrator of the Division of Forestry and Wildlife to negotiate and enter into a Memorandum of Understanding with the Department of Health for rare and endangered native invertebrate emergency evacuation to Department of Health, Environmental Management Division Facilities, Tax Map Key (1) 9-7-025:001, Pearl City, Oahu

And

Request approval of Declaration of Exemption of the project from Chapter 343, Hawaii Revised Statutes.

3. Request preliminary approval of the acquisition of private lands at Maunawili, Ko`olaupoko District, Island of Oahu, identified as Tax Map Key nos. (1) 4-2-006:010, (1) 009:002, and (1) 4-2-008:04.

And

Declare that the land acquisition is exempt from the requirement to prepare an environmental assessment under Chapter 343, Hawaii Revised Statutes, and Chapter 11-200, Hawaii Administrative Rules.

D. LAND DIVISION

1. Rescission of Prior Board Action of April 27, 2018, Item D-2, as Amended, Quitclaim of State’s Interests, if Any, in the Abandoned Government Roadway off Kynnersley Road, to the County of Hawaii, Nunulu Nui, North Kohala, Hawaii, Tax Map Key: (3) 5-4-001: 005; and

Quitclaim Sale of Remnant (Abandoned Government Roadway) to Alice Leiomalama Solomon, as Trustee of the Alice Leiomalama Solomon Revocable Trust dated February 3, 2000, as amended, and Hulali Flora Solomon Covington and Robert Tredwell Covington, Trustees of that certain unrecorded Revocable Living Trust of Hulali Flora Solomon Covington and Robert Tredwell Covington dated March 8, 2021; Dowling Family 2000 Trust; and Marilynn Kanehailua, Raylynn Kanehailua, and Reymond Kanehailua, (collectively as “Applicants”) Kaauhuhu, North Kohala, Hawaii, Tax Map Key: (3) 5-4-001:005.

The reason for the rescission of the prior Board action and the request to convey the abandoned road to Applicants by way of quitclaim is that the County of Hawaii declined to accept the conveyance of the abandoned roadway after Board approval. The Applicants still desire to acquire the abandoned roadway in spite of the County’s decision not to accept the prior Board-approved conveyance.

2. Issuance of Right-of-Entry Permit to Kaikeha, Inc. for 8th Annual Garden Island Boogie Board Classic, Prince Kuhio Beach and Centers Surf Breaks Poipu, Koloa, Kauai, Tax Map Keys: (4) 2-6-005: seaward of 026 and (4) 2-6-005: seaward of 010.

3. Issuance of Revocable Permit and Immediate Right-of-Entry to The Vilcek Foundation, Inc. for Commercial Parking Lot Purposes, Waikiki, Honolulu, Oahu, Tax Map Key: (1) 2-7-036: Portion of 079

4. Issuance of a Month-to-Month Revocable Permit to Yamada Transfer, Inc., and Require Lessee to Post a Removal Bond Covering the Cost of Removing all Improvements from the Premises at the end of the Revocable Permit in the Event the Board Elects such Removal, Waiakea House Lots, Waiakea, South Hilo, Hawaii, Tax Map Key: (3) 2-2-037:089.
