The Board may go into Executive Session pursuant to section 92-5(a)(4), HRS, in order to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.
In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

1. Approval to Enter into a Nondisturbance and Attornment Agreement; Agreement Regarding Distribution of Sales Proceeds; and Consent with Hookuaaina and the City and County of Honolulu to Facilitate Hookuaaina’s Acquisition of Approximately 116.49 Acres at Pālāwai, Koolaupoko District, Island of Oahu, Tax Map Key Nos. 1. Rescission of Prior Board Action of April 27, 2018, Item D-2, as Amended, Quitclaim of State’s Interests, if Any, in the Abandoned Government Roadway off Kynnersley Road, to the County of Hawaii, Nunulu Nui, North Kohala, Hawaii, Tax Map Key: (3) 5-4-001: 005; and

The reason for the rescission of the prior Board action and the request to convey the abandoned road to Applicants by way of quitclaim is that the County of Hawaii declined to accept the conveyance of the abandoned roadway after Board approval. The Applicants still desire to acquire the abandoned roadway in spite of the County’s decision not to accept the prior Board-approved conveyance.
