In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

C.       DIVISION OF FORESTRY AND WILDLIFE

1.     Request the approval of a competitive sealed proposal for a solicitation and to delegate authority to the Chairperson to award and execute a contract to manage Nā Ala Hele Trail Crews on O‘ahu and Hawai‘i Island.

3.     Approval to Commence Condemnation Proceedings to Acquire Private Land Identified as Tax Map Key (1) 7-4-001:025, for the Division of Conservation and Resource Enforcement for Substation Purposes, Located in Wahiawa, Hawaii.

 

F.         DIVISION OF AQUATIC RESOURCES

1.     Request for Authorization and Approval to Issue a Papahānaumokuākea Permit to Mr. James Morioka, Papahānaumokuākea Marine Debris Project (PMDP), for Access to State Waters to Survey and Remove Marine Debris and Disentangle Marine Life as Needed.

2.     Request for Authorization and Approval to Issue a Papahānaumokuākea Native Hawaiian Practices Permit to Pelika Andrade, Nā Maka Onaona and the University of Hawai‘i at Mānoa, for Access to State Waters to use Traditional Ecological Knowledge to Conduct Intertidal Surveys and Monitoring.

1.     Amend prior Board action of January 9, 2026, Item H-2, Request to Conduct Two (2) Public Hearings on the Island of Oahu Regarding Eurus Energy America LLC’s Application to Directly Lease State Lands for the Construction and Operation of a Renewable Hydrogen Generation Facility, Honouliuli, Ewa, Oahu, Tax Map Key: (1) 9-1-031:001; Lot 12022, Map 888, Land Court Application No. 1069; Certificate of Title No. 498,504.

and

Amend Prior Board Action of November 14, 2025, Item H-1, Authorize the Withdrawal of Approximately 100.7 Acres from Governor’s Executive Order No. 4584 to the Department of Agriculture & Biosecurity (formerly known as the Department of Agriculture) for Agriculture Purposes, Honouliuli, Ewa, Oahu, Tax Map Key: (1) 9-1-031:001; Lot 12022, Map 888, Land Court Application No. 1069; Certificate of Title No. 498,504.

The purpose of this amendment is to change the name of the applicant from Eurus Energy America LLC to EE EWA LLC and correct a typographical error.

 

K. OFFICE OF CONSERVATION AND COASTAL LANDS

1.     Proposed Rule Amendment KA 24-01

Request for Public Hearing Regarding a Petition to Amend Hawaiʻi Administrative Rules Chapter 13-5 to Re-designate Land that Lies Within the Conservation District Limited Subzone to the General Subzone by Moloaʻa Lot 10A LLC, managed by William Campbell Located at Moloaʻa, Kawaihae, Kauaʻi, Tax Map Key: (4) 4-9-009:002.
