The Board may go into Executive Session pursuant to section 92-5(a)(4), HRS, in order to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

A.              MINUTES

1.     Approval of February 27, 2026 Meeting Minutes.

 

B.              DIVISION OF CONSERVATION AND RESOURCES ENFORCEMENT

1.     Amend prior board action of May 13, 2022, to delegate authority to the chairperson to negotiate and sign facility use agreements and memorandum of agreements with DOCARE Training Academy Program partners, for the use of any agreements with any federal or government agency, state and county, for the use of the Hawaii Convention Center, Aloha Stadium facilities, and the University of Hawaii for educational support and use of the Marine Education and Training Center, that is necessary to conduct the DOCARE Training Academy Program for entry level Conservation And Resources Enforcement Officer I positions, from July 11, 2022 to March 31, 2023, and for future training academies.

The purpose of this amendment is to clarify that the Board also delegates authority to the Chairperson to negotiate and enter into agreements with federal, state, and county agencies, for the use of their facilities for the DOCARE Training Academy program.

 

C.              DIVISION OF FORESTRY AND WILDLIFE

1.     Request for approval to authorize the Chairperson to negotiate, execute, amend, extend, and terminate a Memorandum of Agreement between the State of Hawaiʻi, Department of Land and Natural Resources, Division of Forestry and Wildlife, and the Big Island Mountain Bike Association for Park Management and Maintenance at Kūlanihākoʻi Mountain Bike Park within Waiākea Forest Reserve, Waiākea, South Hilo, Hawaiʻi Island, Tax Map Key: (3) 2-4-008:022.

2.     Authorize the Chairperson to negotiate, sign, amend, execute, and extend Mutual Aid Agreements with federal and county agencies pursuant to Chapter 185, Hawaii Revised Statutes, for Cooperative Fire Protection and Wildland Fire Suppression.

3.     (1) Approve five grants of available funds from the Fiscal Year 2026 Land Conservation Fund—totaling up to $7,000,000, as requested in applications to the Fiscal Year 2026 Legacy Land Conservation Program and awarded in the order ranked by the Legacy Land Conservation Commission—for the acquisition of interests and rights in specific parcels of land having value as a resource to the state (total area approximately 706 acres), subject to standard conditions, and including contingencies for redistributing unaccepted, non-encumbered, or unexpended funds from a fiscal year 2026 grant award to one fiscal year 2026 grant approved for initial, partial funding (Item (1)E. below):

a.     Save Honolua Coalition, up to $2,021,500 (full funding) for the acquisition of approximately 170.913 acres at District of Lahaina, Island of Maui (Honolua Bay), Tax Map Key Numbers (2) 4-1-001:019, (2) 4-2-001:044, and (2) 4-2- 004:032, with a conservation easement held by the County of Maui or other suitable entities.

b.     Hui Wa‘a O Moloka‘i, up to $318,750 (full funding) for the acquisition of approximately 23.792 acres at District of Molokai, Island of Molokai (Malama Kaunakahakai), Tax Map Key Number (2) 5-3-005:006, with a conservation easement held by the County of Maui or other suitable entities.

c.     KHM International, up to $1,050,000 (full funding) for the acquisition of approximately 7.193 acres at District of Molokai, Island of Molokai (Kalokoeli Shoreline), Tax Map Key Numbers (2) 5-4-005:001, :002, :003, :004, :005, :006, :007, :008, :009, :011, and :044, with a conservation easement held by the County of Maui or other suitable entities.

d.     DLNR-Division of Forestry and Wildlife, up to $3,010,000 (full funding) for the acquisition of approximately 542 acres at District of Hana, Island of Maui (East Maui Coastal Forest), Tax Map Key Numbers (2) 1-2-001:001 (por.), :027, and :045, and (2) 1-2-003:002 and :018, with a grant of exemption for any easement required pursuant to section 173A-4, Hawaii Revised Statutes.

e.     Ke Ao Hali‘i, up to $4,054,900 (with initial, partial funding of up to $600,000) for the acquisition of approximately 115.576 acres at District of Hana, Island of Maui (Haneoo Aina), Tax Map Key Numbers (2) 1-4-007:005, :011, :012, :019, :020, :021, :022, and :033, with a conservation easement held by Hawaiian Islands Land Trust or other suitable entities.

 

(2)  For each grant approved under item (1) above, exempt the award of state funds from the requirement to prepare an environmental assessment, under Chapter 343 Hawaii Revised Statutes and Chapter 11- 200.1, Hawaii Administrative Rules.

(3)  Authorize the Department to proceed with all due diligence and negotiations necessary to carry out the Fiscal Year 2026 Land Conservation Program grants and acquisitions approved by the Board and the Governor.

 

D.              LAND DIVISION

1.     Issuance of Right-of-Entry Permit to Hawaii Beach Volleyball Association for Seven (7) Beach Volleyball Tournaments at Kalapaki Beach, Līhuʻe, Kauaʻi, Tax Map Key: (4) 3-5-002: seaward of 002.

2.     Issuance of Right-of-Entry Permit to the Young Men’s Christian Association of Kauai on behalf of the Kauai Bodyboarding Association for a Bodyboarding Contest Purposes; Keoniloa Beach (also known as Shipwreck Beach), Poʻipū, Kōloa, Kauaʻi,Tax Map Key: (4)  2-9-001: seaward of 004.

3.     Amend Prior Board Action of January 10, 2025, Item D-16, Regarding Revocable Permits for General Industrial Uses at Waiākea, South Hilo, Hawaiʻi, Tax Map Key: (3) 2-2-058:025 to DWE, Inc., Wesco Distribution, Inc., Fastenal Company and John Tavares, to Specify Unit Identifiers and Commencement Dates.

4.     Amend Prior Board Action of January 10, 2025, Item D-17, as amended, Regarding the Issuance of Revocable Permits for General Industrial Uses at Waiakea, South Hilo, Hawaii, Tax Map Key: (3) 2-2-037:081 to Assign Unit Identifiers, Specify the Permit Commencement Date, and replace John Elkjer dba Sustainable Island products with Pacific J Partners LLC dba Sustainable Island Products.

5.     Issuance of Revocable Permit to Andrew J. Baker for Gardening, Landscape, and Maintenance, Honokala, Hamakualua, Makawao, Maui, Tax Map Key: (2) 2-9-002-022.

6.     Approval of: 1) Acquisition of Private Lands Associated with the Wahiawā Irrigation System as Provided for in Act 218, 2023 Session Laws of Hawaiʻi for Addition to the Wahiawā Freshwater State Recreation Area Identified as Tax Map Keys (1) 7-3-001:003 and 019; 7-3-006:023; 7-3-007:001; 7-3-008:001; 7-3-010:003; 7-3-011:003, 006, and 007; 7-3-012: 006; 7-4-001:003; and 7-4-012:001, Located in Wahiawā, Oahu; 2) Rescission of the Wahiawā Dam Remediation Schedule issued to Dole Food Company Hawaiʻi by the Board of Land and Natural Resources (“Board”) on April 9, 2021, as Item L-3 (which was subsequently amended by the Board), upon Transfer of Tax Map Keys (1) 7-3-001:003 and 019; 7-3-006:023; 7-3-007:001; 7-3-008:001; 7-3-010:003; 7-3- 011:003, 006, and 007; 7-3-012: 006; 7-4-001:003; and 7-4-012:001 to the Department of Land and Natural Resources, Tax Map Keys (1) 7-1-001:013 and 017; 7-1-012: 003, 004, 007, and 014; 7-3-005: 005; 7-3-012:002; and 7-3-013:003 to the Agribusiness Development Corporation, including the Wahiawā Dam and the Ditch System Associated with the Wahiawā Irrigation System; 3) Delegation to the Chairperson to Negotiate the Terms and Conditions of the Transfer Agreement; 4) Delegation to the Chairperson to Enter into the Transfer Agreement; 5) Issuance of Management Right-of-Entry to the Division of State Parks; and 6) Issuance of Set Aside to the Division of State Parks for Addition to the Wahiawā Freshwater State Recreation Area for Park Purposes.

F.              DIVISION OF AQUATIC RESOURCES

1.     Request for Authorization and Approval to Issue a Papahānaumokuākea Research Permit to Keolohilani Lopes, University of Hawaiʻi at Mānoa, to Conduct Research Activities for a Chondria Tumulosa Research Project.

2.     Request for Authorization and Approval to Issue a Papahānaumokuākea Research Permit to Anna Mikkelson, University of Hawaiʻi at Mānoa, for the Research and Surveying of Sediment Activities to Determine the Impacts of Extreme Storms and Sea Level Rise on Critical Habitat and Nearshore Marine Environments.

3.     Request that the Board of Land and Natural Resources (BLNR):

(1)  Recognize the Department of Land and Natural Resources’ (DLNR) management authority under HRS § 171-11 and Executive Order No. 4226 (set-aside to DLNR’s Division of Aquatic Resources (DAR) for conservation and management purposes) for State lands at Waiʻanae-Kai, Waiʻanae, Oʻahu, Hawaiʻi, TMK (1) 8- 5-002:011; and

(2)  Delegate to the Chairperson authority to implement temporary, phased access restrictions limited to the minimum extent and duration necessary to:

a.     Protect anchialine ponds and endemic aquatic species (e.g. ōpae ‘ula, anchialine snapping shrimp);

b.     Mitigate documented fire hazards and other safety risks associated with combustible debris and fuel loads;

c.     Conduct debris removal, cleanup, restoration, and resource monitoring, and install protective measures (e.g., fencing) around sensitive features; and

d.     Safeguard cultural sites and burials. (The delegated authority is operational and time-limited, tied to the specific conditions listed above, and shall be exercised only to the minimum extent and duration necessary to accomplish the related management activity); and

(3)  Determine that the requested actions will have little or no significant effect on the environment and are exempt from environmental review under Hawaii Revised Statutes (HRS) Chapter 343 and Hawaii Administrative Rules (HAR) Chapter 11-200.1, consistent with DLNR’s exemption list (Operations/maintenance; debris removal; resources monitoring; hazardous condition mitigation; fencing of sensitive areas).

4.     Request for Authorization and Approval to Issue a Papahānaumokuākea Research Permit to David Hyrenbach, Oikonos-Ecosystem Knowledge and Hawaiʻi Pacific University, to Continue Research Activities for a Black-Footed Albatross Tracking Project.

 

J.               DIVISION OF BOATING AND OCEAN RECREATION

1.     Approve the Request by Maka Kai Charters, Inc. to Privately Finance Repairs to Slip 99, Māʻalaea Small Boat Harbor, Wailuku, Island of Maui, Hawaiʻi.
