We encourage interested persons to submit written testimony in advance of the meeting, which will be distributed to Board members prior to the meeting and allow a timely review. Written testimonies may be posted upon the Board of Land and Natural Resources meeting website; as a precaution, please be mindful with any personal information prior to submitting unless you intend it to be shared. Late written testimony will be retained as part of the record and distributed to Board members as soon as practicable, but we cannot ensure the Board will receive it in sufficient time to review, prior to decision-making.

We kindly ask that all oral/video testimony be limited to not more than two (2) minutes. We ask that you identify yourself and any affiliation before speaking, but you can choose not to do so.

The Board may go into Executive Session pursuant to section 92-5(a)(4), HRS, in order to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

1.     Approval of the July 10, 2026 Meeting Minutes.

 

B.              DIVISION OF CONSERVATION AND RESOURCES ENFORCEMENT

1.     Request to Delegate Authority to the Enforcement Chief of the Division of Conservation and Resource Enforcement to Negotiate, Approve, Execute, Amend, Extend, Renew and Terminate Memoranda of Understanding with County Police Departments and the State Department of Law Enforcement for the Temporary Housing of Detainees.

 

D.              LAND DIVISION

1.     Delegation of Authority to the Chairperson to Select and Appoint a Hearing Officer, and to Issue Preliminary Procedural Orders, for the Contested Case Hearing Ordered by the Hawai’i Supreme Court in Kiaʻi Wai o Waiʻaleʻale v. Board of Land and Natural Resources, SCWC-23-0000383 (Haw. Sept. 30, 2025), Regarding Revocable Permit No. S-7340 to Kauaʻi Island Utility Cooperative for Water Use on the Island of Kauaʻi.

Pursuant to Section 92-5(a)(4), Hawaiʻi Revised Statues (HRS), the Board may enter to into Executive Session to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities and liabilities.

2.     Issuance of Right-of-Entry Permit to Point One Vision on Unencumbered State Lands by Castles Beach, Kailua, Ko’olaupoko, Oahu, Tax Map Key: (1) 4-3-083: seaward of 069 and Unencumbered State Lands by Kokololio Beach, Hauʻula, Koʻolauloa, Oahu, Tax Map Key: (1) 5-5-001: seaward of 002.

1.     Decision Making Regarding:

a.     Petitions for Contested Case Hearing (HA-26-02 and HA-26-03) Filed by Opunaha LLC (Ryan Pastorek) and Paul Pastorek Regarding the Board’s November 14, 2025 Decisions on CDUAs HA-3981 and HA-3982;

b.     Delegation of Authority to the Chairperson to Select and Appoint a Hearing Officer to Conduct the Contested Case Hearing; and

c.     Motion for Reconsideration or Rescission of the Board’s November 14, 2025, Decisions on Conservation District Use Applications HA-3981 and HA-3982.
