We encourage interested persons to submit written testimony in advance of the meeting, which will be distributed to Board members prior to the meeting and allow a timely review. Written testimonies may be posted upon the Board of Land and Natural Resources meeting website; as a precaution, please be mindful with any personal information prior to submitting unless you intend it to be shared. Late written testimony will be retained as part of the record and distributed to Board members as soon as practicable, but we cannot ensure the Board will receive it in sufficient time to review, prior to decision-making.

The Board may go into Executive Session pursuant to section 92-5(a)(4), HRS, in order to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.
In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

F. DIVISION OF AQUATIC RESOURCES
1. Request For Approval To Enter Into a Memorandum of Understanding between the State of Hawaiʻi Department of Land and Natural Resources, acting through its Division of Aquatic Resources, and the Mālama Kai Foundation, a nonprofit organization incorporated in the State of Hawaiʻi, regarding stewardship of Hawaii’s statewide Day-Use Mooring Buoy Program. K. OFFICE OF CONSERVATION AND COASTAL LANDS
The proposed chapter amendments include following:
- Add 20 new definitions, amend 9 definitions, and repeal 2 definitions;
- Adopt 4 new sections for 1) actions that do not require a permit, 2) identified land uses in a new special subzone, 3) requirement of a coastal hazard mitigation disclosure statement, and 4) retroactivity;
- Repeal sections 13-5-36, temporary variance; and 13-5-41.1, fire buffer zone;
- Add new categories to reduce permitting level for native habitat restoration, land maintenance, fishpond restoration, renewable energy, small agriculture, and coral cultivation and transplantation;
- Amend sections on shoreline hardening to bring it into compliance with current State laws;
- Update section on beach restoration;
- Removing “single family residence” as a land use in the Limited Subzone
- Add nine new conservation criteria to be used in evaluating permits;
- Allow the chairperson to waive filing fees for non-profits where the purpose of the project is to preserve and protect the natural or cultural resources of Hawaii;
- Clarify the procedures regarding emergency permits;
- Requiring coastal hazard mitigation disclosure statements for land uses in coastal high hazard areas;
- Adjusting the standard conditions for Conservation District Use Permits;
- Amending the Management Plan Requirements;
- Revising the Single Family Residential Standards; and
- Various amendments to clarify procedures and reduce ambiguity
The proposed rule amendment can be reviewed in person at the Office of Conservation and Coastal Lands (OCCL), 1151 Punchbowl Street, Room 131, Honolulu, Hawaiʻi 96813, from 8:00 am to 4:30 pm, Monday through Friday, except state holidays.
