The Board may go into Executive Session pursuant to section 92-5(a)(4), HRS, in order to consult with its attorney on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities.

In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

5. Request a Six (6) Month Extension of the Board of Land and Natural Resourcesʻ Amendment Which Required the Set Aside of the East Kauai Water and Hanamaulu Ditch Systems to be Brought Back Before the Board Meeting to Allow for Coordination Between the Agribusiness Development Corporation, Land Division, Division of Forestry and Wildlife, Division of Aquatic Resources, and the Engineering Division and Conduct Public Outreach; Portion of Government Lands and Waters Within the Drainage Basins of North Wailua and Kapaa Rivers, Kawaihau, Kauai, Tax Map Key Portions of Sections (4)-3-8, (4)-3-9, (4)-4-2, (4)-4-3, (4)-4-4, (4)-4-5 and (4)-4-6, and including but not limited to diversions on the Kapaa Stream and on the Wailua River at Stable Storm, Wailua Reservoir and Aahoaka Reservoir; the Wailua and Upper Kapahi Reservoirs; and the related transmission and lateral ditch lines as well as portions of the Hanamaulu ditch system that include ditches and reservoirs within the State-owned 6,700 acres behind Kalepa Ridge, currently set aside to ADC under Governor’s Executive Orders 4328, 4401, 4587 and 4594.

J. DIVISION OF BOATING AND OCEAN RECREATION

1. Request approval to initiate rulemaking proceedings, including public hearings, to amend Hawaii Administrative Ru le (HAR) Section 13-232-52, Restricted Areas, and compile HAR Chapter 13-232, Sanitation and Fire Safety.
