In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision. It is up to you. Any request must be made orally by the end of the meeting and followed up in writing within ten days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

- Amend Prior Board Action of January 12, 2018, Item D-7, Resubmittal: Determination of Rent upon Reopening for Milolii-Hoopuloa Residential Leases, Phase III, Consisting of Five (5) General Leases for Residential Purposes at Milolii and Hoopuloa, South Kona, Hawaiʻi, Tax Map Keys: (3) 8-9-014: 050, 053, 056, and 060-061.
The Purpose of the Amendment is to correct the general lease numbers referred therein to General Lease Nos.: S-5226, S-5227, S-5230, S-5235, and S-5236.
- Second Amendment to Prior Board action of September 28, 2018, Agenda Item D-3, Cancellation of Governor’s Executive Order No. 3586 and Reset Aside to Hawaii Housing Finance and Development Corporation (“HHFDC”); Issuance of Management Right-of-Entry to HHFDC for the Development of a Mixed-Use Project Consisting of Multi-Family Affordable Rental Housing, Office Space/Civic Center, Parking, New Maui Bus Hub and Other Incidental Uses Purposes; Kahului, Maui, Tax Map Key: (2) 3-7-004:003.
The purpose of the second amendment is to consent to HHFDC’s issuance of the following Right-of-Entry (“ROE”) permits after Executive Order No. 3586 is cancelled and the land is reset aside to HHFDC: (i) ROE permit to the Department of Education for existing operations of Adult Education and Lawnmower operations, and (ii) ROE permit to Group 70 International, Inc. for Site Investigation, Surveying, Master Planning, Environmental Review, and Special Management Area Assessment purposes for the Kahului Civic Center Mixed-Use project. - Issuance of Right-of-Entry to TS Aloha, Inc. for the Kimo’s Mala Longboard Surf Contest at Lahaina, Maui, Tax Map Key: (2) 4-5-004: seaward of 012.

- Amend Prior Board Action of March 10, 2017, Agenda Item M-11, Cancellation of Governor Executive Order Nos. 1451, 1880, 1950, 2600, 2602, 2705, 2928, 3259 and 3500 and Reset Aside to State of Hawaiʻi, Department of Transportation, Airports Division for Līhuʻe Airport Purposes, Līhuʻe, Hawaiʻi.
The purpose of the Amendment is to: 1) Include Cancellation of Governor Executive Orders (GEOS) in the Recommendation Section, which information was inadvertently omitted, 2) Delete language referring to a Federal Aviation Administration Covenant, and 3) Provide clarification on jurisdiction of Airport Roads.
