Late written testimony will be retained as part of the record and distributed to Board members as soon as practicable, but we cannot ensure the Board will receive it in sufficient time to review, prior to decision-making.

In some of the matters before the Board, a person may wish to request a contested case hearing. If such a request is made before the Board’s decision, then the Board will consider the request first – before considering the merits of the item before it. A person who wants a contested case may also wait until the Board decides the issue, then request the contested case after the decision but before the close of the board meeting. It is up to you. Any request must also be made in writing within ten calendar days. If no request for contested case is made, the Board will make a decision. The Department will treat the decision as final and proceed accordingly.

C. DIVISION OF FORESTRY AND WILDLIFE
1. (a) Approve the Acquisition of Private Lands at Hamakualoa District, Island of Maui, Tax Map Key Nos. (2) 2-9-013:021, (2) 1-1-001:029, and (2) 1-1-001:036;

(b) Approve Post-Closing Issuance of a Management Right-of-Entry for Tax Map Key Nos. (2) 2-9-013:021, (2) 1-1-001:029, and (2) 1-1-001:036 to the Division of Forestry and Wildlife;

(c) Authorize the Maui Branch Manager, Division of Forestry and Wildlife, to Issue Permits Pursuant to Hawaii Administrative Rules Chapters 13-104, 13-22, 13-123, 13-124, 13-126, and 13-209, for Uses of the Lands Identified by Tax Map Key Nos. (2) 2-9-013:021, (2) 1-1-001:029, and (2) 1-1-001:036 until Such Lands are Added to a Forest Reserve;

and

(d) Authorize the Division of Forestry and Wildlife to Conduct a Public Hearing on the Island of Maui for Regarding the Proposed Addition of Approximately 651.8 acres of land at Hamakualoa District, Island of Maui, Identified as Tax Map Key Nos.: (2) 2-9-013:021, (2) 1-1-001:029, and (2) 1-1-001:036 to the Koolau Forest Reserve.

D. LAND DIVISION

1. Set Aside to the Department of Transportation for Pedestrian Safety Improvements Purposes, and Issuance of a Construction and Management Right-of-Entry, Kawailoa-Waimea, Waialua, Oahu, Tax Map Key: Seaward of (1) 6-1-009:Pors 021, 022, (1) 6-1-010:Pors. 019, 020.

2. NON-ACTION ITEM: Discussion Regarding Hawaiʻi Supreme Court Published Opinion in Ke Kauhulu o Mānā v. Board of Land and Natural Resources, No. SCWC18-0000057 (Haw. Aug 26., 2025).

F. DIVISION OF AQUATIC RESOURCES

1. Recommendation to Deny the Written Contested Case Hearing Request Filed by Ron Tubbs et al. Regarding the Board’s Acceptance of a Petition to Initiate Rulemaking Filed by Rulemaking Petitioners Kalanihale, Kamaʻāina United to Protect the ʻĀina (KUPA)/Friends of Ho’okena Beach Park, Moana ‘Ohana, Ko’olaupoko Hawaiian Civic Club, and For the Fishes.

2. Request for Approval to Hold Public Hearings on Proposed Consolidation of Hawaii Administrative Rules (“HAR”) relating to Aquarium Life Management into Proposed HAR Chapter 13-77.1: “Aquarium Fishery Management” and on Proposed Amendments to HAR Chapters 13-75: “Rules Regulating the Possession and Use of

Certain Fishing Gear” and 13-60.4:“West Hawaiʻi Regional Fishery Management Area, Hawaiʻi” for Clarity and Consistency with Proposed HAR Chapter 13-77.1. The Proposed Rules would update and consolidate aquarium life fishery management regulations by:

1) Establishing a standard, State-wide permit for activities relating to aquarium fishing;

2) Repealing the West Hawaiʻi aquarium permit and associated rules from HAR chapter 13-60.4, “West Hawaiʻi Regional Fishery Management Area” (“WHRFMA Rules”);

3) Establishing the West Hawaiʻi geographical endorsement and West Hawaiʻi-specific terms and conditions, a species whitelist (or list of species that are permitted to be kept or traded), and annual catch limits;

4) Moving the aquarium fishing vessel registration and marking requirements from the WHRFMA Rules into the Proposed HAR Chapter 13-77.1 and expanding those requirements to apply State-wide;

5) Establishing commercial aquarium fish dealer registration and requirements; and

6) Other updates to HAR chapters 13-60.4 and 13-75 to address concerns that were identified through public scoping and testimony regarding potential regulatory loopholes, compliance, and enforcement issues.

K. OFFICE OF CONSERVATION AND COASTAL LANDS

1. Request for Administrative Fines and Other Penalties Against the Hawai‘i Loa Ridge Preserve, a Nonprofit Corporation (John Guagliardo, Executive Director), and John Guagliardo “Individually” for Conservation District Enforcement Case OA 25-01 Regarding Unauthorized Land Uses in the Conservation District Located at 184 Pu‘uikena Drive, ‘Āina Haina, Honolulu, Island of O‘ahu, Tax Map Key Nos.: (1) 3-6-004:023 and (1) 3-6-013:121.
